These Terms and Conditions govern the provision of training courses, qualifications, and educational services by Art Educate Ltd, trading as You Academy, a company registered in England and Wales under company number 15628492, with its registered office at 2 Station Court, Radford Way, Billericay, Essex, CM12 0DZ (“You Academy”, “we”, “our”, or “us”).
By enrolling in a course, making a payment, or accessing our website at www.you-academy.co.uk, you agree to be bound by these Terms and Conditions.
1. Definitions
- “Course” means any training programme, qualification, or educational service offered by You Academy, whether delivered in person, online, or through hybrid learning.
- “Learner”, “Student”, “you” or “your” means the individual enrolling in or purchasing a course from You Academy.
- “Platform” refers to any online learning system or software (including Kajabi) used to deliver course content.
- “Awarding Body” refers to VTCT, CIBTAC, or any other recognised qualification provider partnered with You Academy.
- “Ofqual” means the Office of Qualifications and Examinations Regulation.
2. Contract Formation
2.1. A legally binding contract is formed when You Academy issues written confirmation of your enrolment or receipt of payment.
2.2. You confirm that all information supplied during enrolment is accurate and complete.
2.3. You Academy reserves the right to decline enrolment or withdraw access where eligibility criteria are not met or payment obligations are not fulfilled.
3. Payment Terms
3.1. Course fees are payable in full at the time of booking unless a payment plan or alternative arrangement is expressly agreed in writing.
3.2. Accepted payment methods include debit or credit card (via Stripe or Klarna, where applicable) and bank transfer.
3.3. You agree to make all payments on time and understand that failure to do so may result in suspension or termination of course access.
3.4. All fees quoted are inclusive of VAT unless otherwise stated.
4. Refunds and Cancellations
4.1. You Academy operates a 14-day cooling-off period in accordance with the Consumer Contracts Regulations 2013.
4.2. You may request a refund within 14 days of purchase, provided that no course content has been accessed and no training session has been attended.
4.3. Once course content has been accessed, downloaded, or viewed, or once any in-person training has commenced, you forfeit the right to a refund.
4.4. Refunds will be made using the same method as the original payment, within 14 working days of approval.
4.5. After the cooling-off period has expired, all payments become non-refundable.
4.6. Deposit payments are non-refundable under all circumstances.
5. Course Access and Delivery
5.1. Online learning materials are accessible via the Platform for the duration of the course or as otherwise stated.
5.2. Access is granted solely to the registered learner and must not be shared, transferred, or sold.
5.3. You Academy reserves the right to modify, improve, or replace course content, platforms, or delivery methods at any time to maintain quality and compliance.
6. Awarding Bodies and Certification
6.1. You Academy delivers a range of Ofqual-regulated qualifications and You Academy CPD courses, accredited by VTCT, CIBTAC, or internal certification.
6.2. Certification will only be issued once all coursework, assessments, and payments have been completed to the required standard.
6.3. You Academy cannot guarantee qualification award or pass rates; these are subject to learner performance and assessment outcomes.
6.4. You Academy reserves the right to withhold certificates if there are any outstanding fees or breaches of conduct.
7. Learner Conduct
7.1. Learners must behave professionally, respectfully, and safely during all online and in-person sessions.
7.2. You Academy reserves the right to remove any learner from training or revoke access without refund in cases of misconduct, plagiarism, abusive behaviour, or breach of confidentiality.
7.3. All learners must comply with relevant health and safety instructions, hygiene standards, and industry regulations.
8. Intellectual Property
8.1. All course materials, manuals, videos, guides, and resources provided by You Academy remain the intellectual property of Art Educate Ltd.
8.2. No part of any content may be copied, reproduced, distributed, or resold without written permission.
8.3. Learners are granted a limited, non-transferable licence to access and use course materials solely for their own study and professional development.
9. Data Protection
9.1. You Academy processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

10. Limitation of Liability
10.1. You Academy shall not be liable for any indirect, consequential, or incidental loss, including loss of income, business, or reputation arising from course participation.
10.2. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
10.3. You acknowledge that success in your professional practice depends on your individual skill, application, and compliance with relevant legislation.
11. Complaints and Appeals
11.1. You Academy is committed to providing high-quality education and service. If you have a concern or wish to make a complaint, you should submit it in writing to [email protected] within 30 calendar days of the issue arising.
11.2. Representation: Learners are expected to make a complaint themselves. However, in some cases a learner may be unable or reluctant to raise a concern without support. In such circumstances, You Academy will accept a complaint made through a learner’s representative only where the learner has provided written consent confirming their agreementbefore the complaint is accepted. You Academy does not otherwise accept complaints from third parties.
11.3. Complaints will be acknowledged within 2 working days of receipt and investigated thoroughly. A written response will normally be provided within 20 working days.
11.4. Where an investigation cannot be concluded within this timeframe, You Academy will provide written notice explaining the reason for delay and an estimated completion date.
11.5. If you wish to appeal an assessment or grading decision, you must do so in writing within 14 calendar days of receiving your result. Appeals will be reviewed by a senior assessor or internal verifier not involved in the original decision.
11.6. If you remain dissatisfied following internal investigation, you may escalate the complaint or appeal to the relevant awarding body (VTCT or CIBTAC) and, if still unresolved, to Ofqual.
11.7. All complaints and appeals are handled confidentially. Information will only be shared with those directly involved in the process. Learners will not be disadvantaged or penalised for submitting a genuine complaint or appeal.
11.8. Further details of the complaints and appeals process, including the relevant forms and escalation routes, are available within the Learner Portal. All enrolled students are given access upon registration.
12. Force Majeure
12.1. You Academy shall not be liable for any delay or failure to perform its obligations if such delay or failure arises from any cause beyond its reasonable control, including but not limited to acts of God, government restrictions, pandemics, strikes, or power failures.
13. Amendments
13.1. You Academy reserves the right to amend these Terms and Conditions at any time.
13.2. Any changes will take effect immediately upon publication on the website. Learners are encouraged to review these Terms periodically.
14. Governing Law and Jurisdiction
14.1. These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
14.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
